Requirement 1: Do you have an EB-2 basis?

You must qualify for the EB-2 category through one of three routes:

  • Advanced degree: a U.S. master's or higher, or a foreign equivalent.
  • Bachelor's plus five years: a bachelor's degree plus five years of progressive, post-degree experience.
  • Exceptional ability: at least three of six USCIS criteria showing expertise well above ordinary.

If your degree is from outside the U.S., you will need a credential evaluation confirming its U.S. equivalent.

Requirement 2: Can you pass the Dhanasar test?

USCIS decides every NIW case using the three-prong test from Matter of Dhanasar (AAO 2016):

Requirement 3: Is your proposed endeavor specific?

This is where most cases are won or lost. "I will work as an engineer" is a job description. "I will apply my patented flood-modeling method to protect U.S. coastal infrastructure" is a proposed endeavor that USCIS can evaluate.

National importance is judged on your specific endeavor, not on how important your field is in general.

Requirement 4: Do you have the right evidence?

  • Degrees, transcripts and a credential evaluation
  • Detailed experience letters with dates, duties and hours
  • Evidence of results: projects, patents, publications, products
  • 4 to 7 recommendation letters from independent experts
  • Reports or data showing the U.S. need for your work
  • A petition letter tying everything to the three prongs
