What is the E-1 Treaty Trader Visa?

The E-1 Visa is a non-immigrant visa issued to nationals of countries that have a treaty of commerce and navigation with the United States. It provides the right to enter and reside in the U.S. for the purpose of conducting substantial trade in the form of either supplies, services, or technology. To meet the requirements, at least half of that trade or 50% of the total trade must be between the treaty nation and the U.S.

Trade may include physical items such as machines, electronics, consumer goods, or agricultural products and services such as finance, consulting, transportation, or software. E-1 status can be extended for two-year periods indefinitely as long as the trade operations continue and all terms of the visa are met.

Who is Eligible?

To qualify for the E-1 Visa, you need to be a citizen of a treaty country and show a record of “considerable and continuous trade” with the United States. Most of the total trade must be between the U.S. and the treaty country. You are a business owner, executive, manager, or key personnel in a supervisory or critical trade role. Trade must be continuous and high volume; one-off trade or short-term activities cannot be the basis for E-1 Visa eligibility.
